This Acceptable Use Policy ("AUP") governs the use of the EmpTrack AI platform (the "Platform") and forms part of, and is incorporated into, our Terms and Conditions. It is issued in alignment with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Bharatiya Nyaya Sanhita, 2023 (BNS). Capitalized terms not defined here have the meaning given in the Terms and Conditions.
1. Purpose and Scope
1.1. This AUP sets out acceptable and prohibited uses of the Platform to protect EmpTrack AI, its Customers, Authorized Users, Data Principals, and the wider public.
1.2. It applies to all Customers and Authorized Users. The Customer is responsible for ensuring its Authorized Users comply with this AUP.
2. General Principles
You agree to use the Platform:
2.1. only for lawful business HR purposes and in accordance with Applicable Law;
2.2. in a manner that respects the privacy and rights of Data Principals (employees, applicants, and others), consistent with Article 21 of the Constitution of India and the Digital Personal Data Protection Act, 2023; and
2.3. without infringing the rights of EmpTrack AI or any third party.
3. Prohibited Uses — Content
You must not upload, store, transmit, or process any content that:
3.1. is unlawful, defamatory, obscene, harassing, threatening, or that violates the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
3.2. infringes any intellectual property, privacy, publicity, or contractual rights of any person (protected under the Copyright Act, 1957, Trade Marks Act, 1999, and Patents Act, 1970);
3.3. is collected or processed without the lawful basis, consent, or notice required under the DPDP Act, 2023;
3.4. contains malware, viruses, or malicious code; or
3.5. is otherwise prohibited by Applicable Law.
4. Prohibited Uses — Conduct and Security
You must not:
4.1. attempt to gain unauthorized access to the Platform, other accounts, or underlying systems, or bypass authentication, RBAC, or usage limits (such acts may constitute offences under Sections 43, 65, and 66 of the IT Act, 2000, and related offences under the Bharatiya Nyaya Sanhita, 2023);
4.2. interfere with or disrupt the Platform, servers, or networks, including through denial-of-service attacks, excessive automated requests, or circumvention of rate limits;
4.3. reverse engineer, decompile, or attempt to extract source code, except to the limited extent permitted by law;
4.4. use the Platform to build, benchmark, or promote a competing product or to compare against other HRMS tools for public purposes without written consent;
4.5. use the Platform for unlawful surveillance, profiling, or discrimination in violation of privacy, labour, or equal-opportunity laws;
4.6. share, resell, sublicense, or provide access to unauthorized parties; or
4.7. remove or alter any proprietary or security notices.
5. AI Features — Responsible Use
When using AI features (AI Analytics, AI Assistant, AI Insights, Productivity Analytics), you must not:
5.1. attempt prompt injection, jailbreaks, or manipulation to bypass safety or access controls;
5.2. attempt to extract training data, model weights, or confidential system information;
5.3. rely on AI outputs for HR decisions (hiring, performance, disciplinary, or termination) without meaningful human oversight and validation, consistent with Article 14 of the Constitution of India (non-discrimination); or
5.4. use AI outputs in a manner that is unlawful, discriminatory, or misleading.
6. Customer Responsibilities
6.1. Maintain the confidentiality of credentials and enforce MFA/OTP and least-privilege access.
6.2. Ensure Authorized Users are trained on and comply with this AUP.
6.3. Promptly report any suspected security incident or misuse to user.support@emptrackai.online.
6.4. Ensure all data uploaded is lawful and that required consents/notices have been obtained from Data Principals.
7. Monitoring and Enforcement
7.1. EmpTrack AI may monitor use of the Platform to the extent necessary to maintain security, integrity, and legal compliance, in accordance with our Privacy Policy.
7.2. If we reasonably believe this AUP has been violated, we may — with notice where practicable — warn, suspend, restrict, or terminate access, remove offending content, and/or report unlawful activity to competent authorities (including CERT-In).
7.3. Where a violation poses an immediate risk to security, other customers, or legal compliance, we may act without prior notice.

8.2. Complaints will be acknowledged within [48 hours] and handled within the timelines prescribed under Applicable Law.
9. Changes to This AUP
9.1. We may update this AUP to reflect changes in law, technology, or the Platform. Material changes will be notified through the Platform or by email. Continued use after the effective date constitutes acceptance.
